AmeriCharter — Terms & Conditions

Agreement & Acceptance

This Agreement consists of the quote provided to the Client and any amendments thereto, together with these Terms & Conditions. The Client accepts this Agreement by authorizing the Credit Card amount shown in the quote, by clicking to confirm the booking, or by otherwise instructing AmeriCharter to proceed. Any authorization to proceed with the reservation — whether by card authorization, in writing, or verbally — constitutes a confirmed booking subject to these Terms & Conditions. By authorizing or confirming, the Client confirms that the trip details and pricing shown are correct and agrees to these Terms.

Charter Company

Americharter, Inc. arranges charter flights on behalf of its clients and acts as an advocate throughout the process to help secure the best pricing, service, and aircraft tailored to each mission. All flights are performed by properly licensed air carriers who retain full operational control. This includes FAA/DOT-authorized carriers for U.S. flights and foreign operators holding valid air carrier authority in their respective jurisdictions for international service. Americharter does not operate aircraft and is not a direct air carrier. The Client acknowledges that operator-specific terms may apply and may supersede this Agreement for services under their operational control. Operator-specific terms may be provided in advance upon request, or when they materially affect the flight.

Client

The individual and/or legal entity identified in the quote, responsible for the booking, payment, and full compliance with all terms of this Agreement. The Client is also responsible for ensuring that all passengers in their party comply with the terms of this Agreement, including providing required documentation, adhering to flight schedules, and following all conduct, safety, and operational requirements set forth herein and by the operating carrier.

Quote and Validity

Quotes are valid for 48 hours from the time of transmission. Aircraft and crew availability are not confirmed until payment is authorized or secured funds are received, and the booking is confirmed by AmeriCharter. Acceptance is provided by authorizing the card or confirming the booking as described above. All flights remain subject to carrier approval and operational feasibility, and rates are subject to change until confirmed. Confirmed itineraries will be issued once payment and all required passenger information are received. The quote includes only the flight segments specifically listed. Any additional segments remain under the authority of the operating carrier and cannot be accessed without written consent from both parties.

Payment Terms

Payment or secured funds (such as a credit card authorization) are due at the time of booking for all flights, including domestic, international, peak-period, one-way, and discounted charters, unless otherwise agreed in writing. For bookings made less than 72 hours prior to departure, payment must be made immediately by credit card, as wire transfers may not clear in time.

Payment Options

Clients may pay by credit card or, where offered, by wire transfer for the quoted cash price, subject to the timing requirements outlined in the Payment Terms section. Secured funds (credit card authorization) are preferred for all bookings.

Credit Card: A credit card authorization secures the Client’s commitment and allows AmeriCharter to move to confirm the aircraft. Card payments are submitted through AmeriCharter’s secure payment link; full card details should never be sent by email. All credit card payments are subject to a 4% administrative charge.

Authorization Holds: A credit card authorization is a hold, not a charge. Where a card authorization is used to secure a booking that is subsequently paid by wire transfer, the authorization will be voided or released once the wired funds are received, so the Client is not billed twice. If AmeriCharter is unable to confirm the requested aircraft, or if the requested aircraft becomes unavailable before the booking is confirmed, any authorization hold placed for that booking will be voided or released and no charge will be captured. The Client’s booking is confirmed as of the time the Client authorizes or otherwise instructs AmeriCharter to proceed, and the applicable cancellation policy is determined by that time of confirmation.

Wire Transfer: Where offered, the quoted cash price may be paid by wire transfer. Aircraft are not secured or confirmed until wired funds are received. Wire instructions are provided upon request or with your booking confirmation. A legible copy of the responsible party’s driver’s license may be requested to verify identity and authorization, particularly for larger or higher-risk bookings.

Cancellation and Change Policy

Once a booking is confirmed, the following applies:

  • After booking: A 15% non-refundable cancellation fee applies unless otherwise stated in writing.
  • Within 7 days of departure: 50% of the quoted flight cost will be charged.
  • Within 72 hours of departure: 100% of the quoted flight cost will be charged.
  • Peak periods and holidays: 100% cancellation charge applies once the booking is confirmed.
  • Empty leg and one-way charters: 100% cancellation charge upon confirmation.

Peak Travel Periods

November 20 – December 7  •  December 18 – January 10  •  July 1 – July 8

Peak travel restrictions and cancellation policies also apply to flights scheduled within three (3) days before or after these date ranges, as well as during widely recognized public holidays, major sporting events, concerts, or other high-demand periods.

Passenger Information

Client must provide full legal names, dates of birth, and weights for all passengers in order to complete the trip itinerary and comply with TSA and operational planning requirements. For international flights, passport and/or visa copies must be submitted in advance, as required by Customs and foreign immigration authorities. All required documentation must be submitted to Americharter in advance for compliance review and processing. Passengers aged 18 and older must carry valid government-issued photo identification. Minors must be accompanied by a parent or legal guardian. All passengers must retain proper identification throughout the journey, as required by TSA, Customs, and airport authorities.

Aircraft Access

Trip sheets will contain the aircraft tail number and FBO (terminal) location. Passengers should present the tail number upon arrival. Drivers arriving for pick-up without a passenger must check in at the FBO reception. Access is subject to the policies of the FBO and/or airport. Clients may contact the FBO using the phone number provided in the trip sheets if further instructions are needed.

Arrival Time

Passengers are advised to arrive at the designated FBO at least 15 minutes prior to the scheduled departure time for domestic flights. For international flights, or departures from commercial airports, earlier arrival is recommended to accommodate customs scheduling, immigration, and any additional security procedures.

Ground Transportation

Please notify Americharter of the type of ground transportation being utilized (e.g., chauffeured service, valet, self-parking, rental car, or private pick-up). Where permitted, ramp or planeside access may require prior authorization or escort. Americharter may provide specific instructions or coordinate special arrangements to ensure that ground transportation aligns with FBO procedures and aircraft accessibility.

Catering

Standard in-flight stock typically includes soft drinks, bottled water, and light snacks, with offerings varying by aircraft. Super-Mid and Heavy Jet aircraft may also include premium alcoholic beverages and upgraded snacks. Additional catering is available upon request, but it is often pricey and may be subject to delivery, fuel, handling, inspection, or FBO-related charges depending on the location and aircraft. Clients are generally welcome to bring their own food and beverages onboard. Any special catering requests or accommodations should be submitted at least 24 hours in advance. Availability may be limited in rural, international, or island locations due to logistical or regulatory constraints.

Operational Requirements

All passengers must comply with TSA, FAA, and applicable aviation and governing security regulations. Smoking, including the use of electronic cigarettes, vapes, and smokeless tobacco, is strictly prohibited onboard. Pets must be approved at the time of booking and may incur a non-refundable pet fee. Any cleaning or damage caused by pets will be billed to the Client at actual cost, which may include aircraft downtime. Unauthorized or unapproved pets may result in denied boarding.

Prohibited Items

Clients must comply with all TSA and international regulations regarding restricted items. A list of prohibited items can be found on the official TSA website.

Trip Sheets

Trip sheets contain all critical flight details, including the confirmed itinerary, passenger list, departure procedures, and operational notes. Clients must review these documents carefully upon receipt and immediately notify Americharter of any inaccuracies or required changes. Last-minute adjustments or delays caused by the client or passengers may result in additional costs, scheduling changes, or crew duty restrictions, which could limit aircraft availability. Americharter will make every reasonable effort to accommodate such changes, subject to operational feasibility.

Discounted One-Ways / Empty Legs

Empty leg or discounted one-way flights are priced based on aircraft positioning and are subject to limited availability. These options may require client flexibility. Last-minute changes may result in pricing adjustments or loss of availability. Tail numbers (the identifying number of the aircraft) are subject to change and will be reconfirmed the day before departure.

Fixed Base Operators (FBO)

The operating carrier determines the FBO used for departure and arrival. If the Client requests a specific FBO, surcharges may apply. All FBO use is subject to availability and operational conditions.

Additional Charges

The Client agrees to be responsible for any and all additional charges incurred as a result of itinerary changes or operational factors, including but not limited to: weather delays, routing changes, de-icing, diversions, landings, extended wait time, standby requests, crew overnight accommodations, or service upgrades. All additional requests for incidentals such as Wi-Fi, ground transportation, catering, flight phone usage, and lodging will be billed to the Client upon completion of the charter.

Aircraft Damage

The Client is responsible for all damages to the aircraft interior, furnishings, or entertainment systems caused by the Client or their guests, and agrees to pay any resulting repairs.

Force Majeure

Americharter shall not be held liable for any delay, cancellation, or failure to perform its obligations under this Agreement due to causes beyond its reasonable control. These include but are not limited to acts of God, weather conditions, mechanical failures, labor strikes, war, terrorism, civil disturbances, governmental regulations, airport closures, crew duty limitations, or any other events that make performance impractical or unsafe. In such cases, Americharter will make reasonable efforts to notify the Client and assist with alternate arrangements where feasible, but shall not be responsible for any resulting damages or costs.

Indemnification and Limitation of Liability

The Client agrees to indemnify, defend, and hold harmless Americharter Inc., its affiliates, officers, employees, agents, and representatives from and against any and all claims, liabilities, losses, damages, demands, suits, costs, or expenses (including attorneys’ fees) arising from or related to any breach of this Agreement, any actions or omissions of the Client or their guests, any operational issues or delays outside the control of Americharter, and any injury, death, loss, or property damage occurring in connection with any flight or third-party service. Americharter shall not be liable for any consequential, indirect, incidental, punitive, or special damages of any kind.

Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict of law principles. Any disputes arising out of or relating to this Agreement shall be resolved exclusively through binding arbitration in Clark County, Nevada. The Client agrees that Nevada is a reasonable and proper forum, and waives any objection to venue or jurisdiction.

Wire Instructions

Wire instructions are provided upon request or with your booking confirmation. Aircraft are not secured or confirmed until wired funds are received.

Americharter, Inc. reserves the right to update these Terms & Conditions. The version in effect at the time of your booking governs your charter. Last updated: June 2026.
